Noise Emission in the Environment by Equipment for Use Outdoors Regulations 2001 SI 1701 as amended

The UKCA Marking according to Noise Emission in the Environment by Equipment for Use Outdoors Regulations 2001, as amended by Product Safety and Metrology etc. (Amendment etc.) (EU Exit) Regulations 2019 (Schedule 8), represents a mandatory requirement for the marketing of machinery within the United Kingdom, promotes noise reduction and requires manufacturers to comply with noise emission limits.

WHAT DOES IT APPLY TO?

The Noise Emission in the Environment by Equipment for Use Outdoors Regulations 2001, in accordance with the amendments established in the Regulations 2019, imposes the obligation of Noise Marking, with the intervention of an Approved Body such as ECO Certifications UK, to all listed equipment and machinery in Schedule 1 (for which the emission limit values are also defined) and the affixing of the Noise Marking for the machinery listed in Schedule 2 (for which, therefore, the drafting of a technical documentation associated with a rigorous internal manufacturing control by the manufacturer).

CERTIFICATION PROCEDURES

The Noise Emission in the Environment by Equipment for Use Outdoors Regulations 2001, for the machinery listed in Schedule 1, provides for four different certification procedures:

  • Internal Control of Production (Schedule 8, Part B – Annex V): this procedure must always and in any case be implemented by the manufacturer, even if the product is certified by an Approved Body according to Internal Control of Production with Assessment of Technical Documentation and Periodical Checking or Unit Verification.
  • Internal Control of Production with Assessment of Technical Documentation and Periodical Checking (Schedule 9, Part B – Annex VI): is applied if the manufacturer complies with the requirements set out in Points 2, 5 and 6 and provides for the assessment by an Approved Body with the issue of the UKCA Certificate with three-year validity, in the event of a positive outcome. Over the three-year period, based on the productions, at least two surveillances will be provided.
    The certification process involves an initial documentary analysis and, subsequently, the performance of noise tests on equipment/machinery. The latter can be carried out directly by the manufacturer (Procedure 1) or by the Approved Body (Procedure 2).
  • Unit Verification (Schedule 10, Part B – Annex VII): provides for the assessment by an Approved Body on the single sample with the release of the UKCA Certificate, in the event of a positive outcome.
  • Full Quality Assurance (Schedule 11, Part B – Annex VIII): is applied if the manufacturer complies with the requirements set out in Point 2 and provides for the verification by an Approved Body with the issue of the UKCA Certificate with three-year validity, in the event of a positive outcome. During the three-year period, at least two surveillance is scheduled.
    The manufacturer adopts an approved quality system for the design, manufacture and final verification and testing of the product, as specified in Point 3, and is subject to the surveillance referred to in Point 4.

The machinery indicated in Schedule 2 do not require verification by the Approved Body; however, the manufacturer is obliged to adpsts the Internal Control of Production (Schedule 8, Part B – Annex V).
