Supply of Machinery (Safety) Regulations 2008 SI 1597 as amended

Marking UKCA under the Supply of Machinery (Safety) Regulations 2008, as amended by Product Safety and Metrology etc. (Amendment etc.) (EU Exit) Regulations 2019 (Schedule 12), represents a mandatory requirement for the marketing of machinery within the United Kingdom.

WHAT DOES IT APPLY TO?

The Supply of Machinery (Safety) Regulations 2008, in accordance with the changes established in Regulations 2019, applies to the following products:

  • MACHINERY;
  • INTERCHANGEABLE EQUIPMENT;
  • SAFETY COMPONENTS;
  • LIFTING ACCESSORIES;
  • CHAINS, ROPES AND WEBBING;
  • REMOVABLE MECHANICAL TRANSMISSION DEVICES;
  • PARTLY COMPLETED MACHINERY.

that is, to all equipment covered by the definition of “machinery” in Part 2 of the Supply of Machinery (Safety) Regulations 2008 itself.

CERTIFICATION PROCEDURES

The Supply of Machinery (Safety) Regulations 2008 provides for three different certification procedures for the machinery contemplated in the list in Schedule 2, Part 4 – Annex IV, whether they are built completely or partially in accordance with the requirements of the relevant harmonized standards (ref. Part 3, point 4), always and in any case in compliance with the essential health and safety requirements, as defined in Schedule 2, Part 1 – Annex I.

  • Assessment of Conformity with Internal Checks on the Manufacture of Machinery (Schedule 2, Part 8 – Annex VIII): this procedure must always and in any case be implemented by the manufacturer, even if the product is certified by an Approved Body according to Internal EC Type-Examination or Full Quality Assurance.
  • EC Type-Examination (Schedule 2, Part 8 – Annex IX) and Full Quality Assurance (Schedule 2, Part 9 – Annex X): these procedures always provide for the verification of an Approved Body with the issue, in the event of a positive outcome, of the UKCA Certificate; however, if the machinery fully comply with harmonized standards, the manufacturer is not obliged to implement one of these two procedures (in this case we speak of “self-certification”).
    Following a positive outcome of the compliance assessment, in the case of EC Type-Examination, the Approved Body issues a certificate with five-year validity while, in the case of Full Quality Assurance, the certificate issued is valid for three years and provides for annual inspections by of the Approved Body.

In the event that the machinery is not in the Schedule 2, Part 4 – Annex IV list, the manufacturer is obliged to carry out the Assessment of Conformity with Internal Checks on the Manufacture of Machinery (Schedule 2, Part 8 – Annex VIII) and may in any case submit, upon voluntary request, the machine or the technical file to be checked by an Approved Body, which will issue a certificate, without the UKAS logo, of compliance with the applicable standards and / or the Supply of Machinery (Safety) Regulations 2008: a useful support for UKCA Marking and product marketing.

It is understood that these machineries must in any case be built always and in any case in compliance with the essential health and safety requirements, as defined in Schedule 2, Part 1 – Annex I.
